1. Scope of Services:
- Plain Blue specialises in luxury wedding photography and filmmaking services, with a focus on destination weddings, adventure weddings, elopements, and other bespoke celebrations.
- Our services include but are not limited to photography coverage, videography coverage, pre-wedding consultations, custom packages, destination planning assistance, and post-production editing.
2. Booking and Payment:
- To secure our services for your wedding or event, a non-refundable booking fee is required at the time of booking.
- Payment plans and schedules will be discussed and agreed upon during the booking process.
- The remaining balance is due one month (30 days) before or the day of the wedding or event.
- Additional fees may apply for travel, accommodation, and other expenses related to destination weddings or events.
3. Cancellation and Refunds:
- In the event of cancellation by the client, the non-refundable booking fee will not be returned.
- Any cancellations made within a specified timeframe before the wedding or event may incur additional fees.
- Refunds or credits for cancellations or modifications to services will be granted at the discretion of Plain Blue and in accordance with our cancellation policy.
4. Intellectual Property:
- All photographs, videos, and other creative works produced by Plain Blue are the intellectual property of Plain Blue.
- Clients are granted a personal, non-commercial, and non-transferable license to use and share the images and videos for personal use only, including but not limited to sharing on social media, personal websites, and printing for personal use.
- Commercial use, distribution, or reproduction of our creative works without prior written consent is strictly prohibited.
5. Privacy and Confidentiality:
- Plain Blue respects the privacy and confidentiality of our clients and their personal information.
- Any information shared with us during consultations, bookings, or throughout the duration of our services will be kept confidential and used solely for the purpose of providing our services.
6. Liability and Indemnification:
- Plain Blue shall not be liable for any damages, losses, or injuries incurred during the course of our services, including but not limited to accidents, equipment failure, or unforeseen circumstances.
- Clients agree to indemnify and hold harmless Plain Blue and its affiliates, employees, and contractors from any claims, liabilities, or expenses arising from the use of our services.
7. Governing Law and Dispute Resolution:
- These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa.
- Any disputes or claims arising from these terms and conditions or the use of our services shall be resolved through arbitration in the Republic of South Africa in accordance with the rules of the AFSA Divisions and Services.
8. Amendments and Updates:
- Plain Blue reserves the right to amend or update these terms and conditions at any time without prior notice.
- Clients are encouraged to review these terms periodically for any changes or updates.
Cancellation Policy
At Plain Blue, we understand that unforeseen circumstances may arise that require you to cancel or modify your wedding or event plans. We strive to accommodate our clients to the best of our ability while also maintaining the integrity of our business operations. Please review the following cancellation policy for information on cancellations, refunds, and modifications to our services:
1. Cancellation by the Client:
- If you need to cancel your booking with us, please notify us as soon as possible in writing.
- A non-refundable booking fee is required at the time of booking to secure our services. This deposit will not be returned in the event of cancellation by the client.
- Depending on the timing of the cancellation and the proximity to the scheduled wedding or event date, additional cancellation fees may apply.
- Refunds or credits for cancellations or modifications to services will be granted at the discretion of Plain Blue and in accordance with the terms outlined below.
2. Refund and Credit Policy:
- Non-refundable Deposit: The non-refundable booking fee paid at the time of booking will not be returned under any circumstances.
- Cancellations within 30 Days of Event: Any cancellations made within 30 days of the scheduled wedding or event date may incur additional cancellation fees, up to 100% of the total package price.
- Refunds or credits for cancellations made within 90 days of the event will be granted at the discretion of Plain Blue and may be subject to a deduction for unrecoverable expenses incurred by Plain Blue in preparation for the event.
3. Modification of Services:
- Clients may request modifications to their booked services, such as changes to the event date, venue, or package details, subject to availability and approval by Plain Blue.
- Any modifications to services may result in additional fees or adjustments to the total package price, which will be communicated to the client and agreed upon in writing before the changes are implemented.
4. Force Majeure:
- In the event of force majeure or circumstances beyond our control that prevent us from fulfilling our obligations under the contract, Plain Blue reserves the right to cancel or modify services as necessary.
- In such cases, Plain Blue will make every effort to accommodate the client’s needs and preferences, including rescheduling services to a mutually agreeable date or providing alternative solutions.
